Terms and Conditions - General Terms and Conditions and Customer Information

 

1. Contract basis
a) These General Terms and Conditions govern the contractual relationship between Juramed GmbH, Mühlweg 15a, 92369 Reichertshofen, Tel. +49 (0) 9181 261100, Email mail@juramed.de, Fax +49 (0) 9181 261101 (hereinafter "Seller") and customers for sales via the online shop www.juramed-schmerzfrei-leben.com about the goods placed by the seller.Customers within the meaning of these provisions are both consumers (any natural person who concludes a legal transaction for purposes that are predominantly neither their commercial still an independent professional activity) as well as an entrepreneur (any natural or legal person or a legal partnership that in the conclusion of a legal transaction in the exercise of their commercial or self-employed professional activity).

2. Offer, conclusion of the contract, correction options, contract text storage
a) The product description on the online shop pages of the seller are non-binding offers for placing an order. After passing through the ordering process by the customer, the purchase contract comes after receipt of the customer's binding order by submitting the contract confirmation by the seller (eg by phone, per Fax, e-mail or letter). The automatic confirmation of the order receipt, sent first, does not constitute acceptance of the contract offer, but merely confirms the receipt of the order. If the contract offer is not accepted within 2 days, this is considered rejected and the customer is no longer bound by it.
b) To submit the customer's binding order via the seller's online shopping cart system, the customer places the selected article (s) in the virtual shopping cart by clicking on the "Add to Cart" button. The customer can open this at any time by clicking on the button of the same name or the cart symbol on the upper right side of the page and making changes. After the customer has placed the desired articles in the "shopping cart", the customer first reaches the shopping cart by pressing the "checkout" button to enter the personal data or the login area if the customer has already set up an account with the seller Has. In the following sequence, the customer reaches the order overview page by selecting the payment method and shipping method. Here the customer can once again check all order data and if necessary make changes or adjustments (for example by clicking the link "back to the shopping cart or also by pressing the" back "function of the Internet browser) or cancel the order (eg by closing the browser window ). c) PayPal
If the customer decides to use the "PayPal" payment method, the contract between the customer and the seller immediately comes into effect, contrary to clause 2.a), by pressing the button "Buy". At the end of the order process, the input mask of PayPal appears in which the customer enters his PayPal email address and his PayPal password. Upon confirmation of payment by the customer, the purchase price, including any shipping costs, arising from the purchase contract for the products selected by the customer will be credited directly to the account of the seller. The dispatch takes place one working day after payment instruction, equivalent to the receipt of the payment.
d) If the customer sends an offer or a request, for example, via a contact form, by e-mail, fax, letter or telephone to the seller, the seller sends the customer a binding offer by e-mail, which the customer within 5 days can accept. To save the transmitted contract data, the customer can print it out or save it on his PC or another electronic data carrier.
e) Note on contract text storage
The data of the customer's order and the text of the contract are not stored by the seller in a form that is subsequently accessible to the customer. In the event that the customer wants to document his order data, the customer can copy this before submitting the binding order, print or otherwise save.The seller will notify the customer at the latest on delivery of the goods a contract confirmation in which the contract is reproduced.

3. Payment, delivery
a) Unless otherwise agreed, the delivery of an ordered goods is made exclusively against payment in advance (ie by bank transfer) or payment by Pay Pal, to the address deposited in the course of the ordering process. If the customer and the seller have not agreed otherwise, payment in advance is due immediately after conclusion of the contract.
b) The delivery takes place within 5 working days, if not in the article description another delivery time indicated or this was expressly agreed with the customer. The delivery period starts one day after the transfer has been made (issuing the money order to the bank)
There are no deliveries on Sundays, holidays and Saturdays.
If the customer wants to make use of the possibility of picking up, there will be no shipping costs. The seller first sends the customer an e-mail stating that the goods are ready for collection by the customer. This can then be picked up by appointment with the seller by the customer.
c) If the customer chooses the option of payment via PayPal, payment processing will be handled by PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. d) In the case of payment on collection, the seller informs the customer about the provision of the goods for collection. Then agree the seller and the customer an appointment to pick up the goods at the seller.

4. Prices and shipping costs
a) All prices are in Euro (€) and include VAT, as well as other price components and any other applicable taxes and duties (total price / final price). The prices apply exclusively to orders via our online shop.
b) The product prices are the respective packaging / shipping costs according to item description, which are listed under the link "Shipping and Payment".
c) In addition to the shipping costs may be due for deliveries outside Germany duties, customs duties and import sales taxes. These costs are borne by the customer and are usually not collected by the seller. The customer indemnifies the seller against any claim for these costs. 5. Warranty
a) Unless otherwise stipulated in b) and c) the customer is entitled to the statutory warranty rights.
b) For consumers, the warranty claims expire one year after the transfer of risk when purchasing used items. For entrepreneurs, claims for defects for new goods become time-barred one year after the transfer of risk, for used goods the warranty is excluded.

6. Retention of title
The goods sold remain the property of Juramed GmbH, Mühlweg 15a, 92369 Reichertshofen until full payment. He undertakes to inform the seller immediately if third parties assert rights to the goods.

7. Jurisdiction agreement
a) If the contractual partner is a merchant, a legal entity under public law or a special fund under public law, our place of business - 92369 Reichertshofen / Sengenthal - shall be the exclusive place of jurisdiction for all claims arising out of or on the basis of this contract.
b) Section 7. a) shall also apply to persons who have no general place of jurisdiction in Germany, or persons who have relocated their domicile or habitual residence outside of Germany after conclusion of the contract, or their domicile or habitual residence at the time of filing of the claim This does not apply if the customer is a consumer and has his domicile or habitual residence in a member state of the European Union. In this case, an action must be brought before the competent court of the Member State of residence.

8. Obligations of the customer
The customer must ensure that the email address he has provided to the seller is correct. Furthermore, it must be ensured by the customer that he can receive emails under the stored address and this is not prevented in particular by a SPAM filter in order to ensure access to the information, which in part is automatically transmitted by email and which is required within the scope of the contract.

9. Information on online dispute resolution.
Since February 15, 2016, the EU Commission has been providing an Internet platform for the online settlement of disputes (so-called "OS platform").
